台榮產業於112年起制定智慧財產管理計畫,計畫內容如下 :

一、計畫之目的
為保護企業品牌形象、保護營業機密、強化競爭優勢、提升企業獲利、達成營運目標、確保永續經營,依據公司需求,建立良好之智慧財產管理制度並且持續推動。

二、本公司的智慧財產保護政策目標如下 :
(一) 確保本公司的智慧財產不受侵害
(二) 預防侵害他人的智慧財產
(三) 重視智慧財產的開發與建立
(四) 發揮智慧財產的最大利基
(五) 定期向最高治理單位及大眾揭露執行狀況

三、保護措施
(一) 定期商標及專利監控
充分掌握市場及競業資訊,以了解同質商品在市場上的最新狀況。
(二) 定期資訊分享
蒐集各方資訊,將產業相關最新製程、配方、原物料等資訊進行內部分享,以激發研發同仁的創造力及厚植研發潛力。
(三) 定期維護及檢討
1.商標
定期檢視已註冊商標之使用情形,以評估繼續展延的必要性,並針對本公司未來產品發展之規劃,提前規劃新商標註冊申請。
2.專利
針對相關製程技術等研擬是否具有申請專利之可能性,以保持在同業中優勢競爭能力。
3.營業秘密
(1) 門禁管理
本公司各營業點均設有門禁管制,營業秘密保存位置均另行上鎖,由專責管理主管負責相關保管事項。
(2) 資訊安全管理
個人電腦均依照資通安全維護計畫設置密碼,營業秘密另存於可攜帶式硬碟,由專責管理主管保管,並設置密碼。相關密碼均定期更新。
(3) 審查會議
各項營業秘密均由審查會議通過列案,解密時亦同。相關會議人員均須簽署保密協定。
(四) 教育訓練
1.新進同仁入職時,均簽訂著作權歸屬同意書、保密協定同意書,並列為新進人員教育訓練課程,強化著作權概念、保密保防觀念等。
2.每年辦理資通安全、著作權內部教育訓練,持續強化同仁相關觀念。

四、執行情形定期報告 本公司定期於每年第4季將智慧財產相關事項提報至董事會報告,並於報告後公告於公司官網智慧財產專區。

Tairoun Products has formulated an Intellectual Property Management Plan starting from 2023, with the following plan details:

I. Objectives of the Plan
The purpose of the plan is to establish a robust intellectual property management system and continuously promote it to protect the company's brand image, safeguard business confidentiality, strengthen competitive advantages, enhance corporate profitability, achieve operational goals, and ensure sustainable business operations based on the company's needs.

II. Intellectual Property Protection Policy Objectives
1. Ensure the integrity of the company's intellectual property.
2. Prevent infringement of others' intellectual property.
3. Emphasize the development and establishment of intellectual property.
4. Maximize the benefits derived from intellectual property.
5. Regularly disclose the execution status to the highest governing body and the public.

III. Protection Measures
1. Regular Trademark and Patent Monitoring
Thoroughly grasp market and industry information to understand the latest developments of similar products in the market.

2. Regular Information Sharing
Collect information from various sources and internally share the latest industry processes, formulations, raw materials, etc., to stimulate the creativity of research and development personnel and cultivate research and development potential.

3. Regular Maintenance and Review
  a. Trademarks
Regularly review the use of registered trademarks to assess the need for continued extension. Plan new trademark registrations in advance based on the company's future product development.
  b. Patents
Evaluate the possibility of applying for patents for relevant process technologies to maintain a competitive advantage in the industry.
  c. Trade Secrets
    (1) Access Control
All business locations have access control, and locations storing trade secrets are separately locked, managed by designated supervisors responsible for related storage matters.
    (2) Information Security Management
Personal computers are password-protected according to the information security maintenance plan. Trade secrets are stored on portable hard drives, managed by designated supervisors, and password-protected, with regular updates.
    (3) Review Meetings
All business secrets are approved and recorded by review meetings, and the same applies when decrypting. Relevant meeting participants are required to sign confidentiality agreements.

4. Education and Training
  a. New employees sign copyright assignment agreements and confidentiality agreements upon joining and are included in the new employee education and training program to reinforce concepts of copyright and confidentiality.
  b. Conduct annual internal education and training on information security and copyright to continuously strengthen employees' relevant concepts.

IV. Regular Reporting of Execution Status
The company reports intellectual property-related matters to the board of directors every fourth quarter and announces them on the company's website in the Intellectual Property section after the report.

113年度執行重點為清查本公司現有專利及商標情況, 專利管理 本公司目前無申請任何專利。 商標管理 目前公司尚在專用期間內的共計10個商標,如下表所示 :

綜觀目前已申請且在效期之商標,具有以下情況,擬列為113年主要智財工作推動方向 :

  1. 針對目前已停產產品之商標進行是否持續維持專用評估。
  2. 針對目前仍使用商標的保護程度進行評估。
  3. 針對商標各式組合評估申請效益,如中文字加圖樣、英文字加圖樣。
  4. 擬恢復申請本公司舊有商標,經評估該商標雖未使用,但具有保存價值,為避免該商標遭其他同業或商標蟑螂註冊,建議恢復。

三、競業及近似商標

113年度針對與本公司相同或近似產品搜尋商標,並未發現與本公司近似之商標,新申請案亦無。

Overview of the current trademarks that have been applied for and are in effect reveals the following situations. The proposed key intellectual property initiatives for 2024 are as follows:

1. Evaluation of Trademarks for Discontinued Products:
  - Assess the continued maintenance of trademarks associated with products that are currently discontinued.
2. Evaluation of Protection Level for Currently Used Trademarks:
  - Evaluate the level of protection for trademarks currently in use.
3. Assessment of Various Combinations of Trademarks:
  - Evaluate the effectiveness of applying for trademarks in various combinations, such as combining Chinese characters with graphic elements or combining English characters with graphic elements.
   Competitor and Similar Trademarks:
4.The company intends to apply for the restoration of its old trademark. After evaluation, it has been determined that although the trademark is not in use, it holds preservation value. To prevent the trademark from being registered by competitors or trademark squatters, it is recommended to restore the registration.

  - In the fiscal year 2024, conduct searches for trademarks related to identical or similar products to identify any potential conflicts. No similar trademarks were found, and there were no new applications that posed concerns.

These initiatives aim to strategically manage and optimize the portfolio of trademarks, ensuring their relevance, effectiveness, and protection in alignment with the company's business objectives for the year 2024.
